Nowadays, bank accounts are being frozen on a massive level across India, regardless of which bank you hold your account in. If there is any transaction in your bank account that the bank feels does not match your regular transaction history, the bank freezes your entire account.
After this, you cannot even withdraw your own money.
If you want to get your bank account unfreezed/free of lien ,The bank officials will provide you with the details of an Income Tax officer to get your bank account unfrozen, stating that a lien has been placed on your account by the Income Tax Department, and you should speak to them to get the lien removed.
If you keep money in the bank, you need to keep this matter in mind, but if this has happened to you, there is no need to panic. You just need to take care of a few things.
First of all, you must ask the bank officials why this lien has been placed. As soon as the bank officials confirm the reason, you must give them a written statement highlighting the High Court judgment which states that you cannot freeze any bank account just like that. If there is a doubt or dispute regarding a specific transaction, you can only freeze. that particular amount.
Banks are instructed by High Court to put a hold (lien) only on the specific disputed amount under investigation.
Banks cannot keep your account frozen forever without a formal, written legal order from the court and freeze must typically clear maximum 3 months.
The second thing you can do is file a complaint on the Ombudsman portal under the RBI (Reserve Bank of India).
None of your conversations with the bank and any concern authority should be verbal.
